Ce texte pr\u00e9voit des dispositions visant \u00e0 faciliter la construction de nouveaux logements et l&rsquo;agrandissement de logements existants pour faire face \u00e0 la p\u00e9nurie d&rsquo;offres. Les droits \u00e0 construire, qui r\u00e9sultent de l&rsquo;application des r\u00e8gles des plans d&rsquo;occupation des sols et des plans locaux d&rsquo;urbanisme, sont augment\u00e9s de 30 %, que ces r\u00e8gles portent sur le gabarit, la hauteur, l&#8217;emprise au sol ou le coefficient d&rsquo;occupation des sols. Cette mesure est limit\u00e9e dans le temps \u00e0 trois ans. La majoration s&rsquo;applique dans les communes dot\u00e9es d&rsquo;un plan local d&rsquo;urbanisme, d&rsquo;un plan d&rsquo;occupation des sols ou d&rsquo;un plan d&rsquo;am\u00e9nagement de zone en vigueur \u00e0 la date de promulgation de la loi. Le texte pr\u00e9voit la possibilit\u00e9 pour une commune ou un \u00e9tablissement public de coop\u00e9ration intercommunale (EPCI) de s&rsquo;opposer, par une d\u00e9lib\u00e9ration expresse, \u00e0 l&rsquo;entr\u00e9e en vigueur automatique de la mesure sur tout ou partie de son territoire, pr\u00e9servant ainsi le principe de libre administration des collectivit\u00e9s locales.<\/div>\n<div><\/div>\n<div><b>Illustration des effets de la mesure<\/b><\/div>\n<div><\/div>\n<div><b>1. Le bonus de COS (coefficient d&rsquo;occupation des sols) :<\/b><\/div>\n<div><\/div>\n<div>Exemple d&rsquo;application : Sur un terrain de 1 000 m\u00b2, dont le r\u00e8glement pr\u00e9voit un COS maximal de 0,4 on peut construire jusqu&rsquo;\u00e0 1 000 m\u00b2 x 0,4 = 400 m\u00b2 SHON (surface hors oeuvre nette). Avec une majoration de 20 %, on pouvait construire 1 000 m\u00b2 x 0,48 = 480 m\u00b2. Avec une majoration de 30 %, la constructibilit\u00e9 passe \u00e0 520 m\u00b2 :<\/div>\n<div><\/div>\n<div><b>2. L&rsquo;augmentation de l&#8217;emprise au sol :<\/b><\/div>\n<div><\/div>\n<div>Exemple d&rsquo;application : Sur un terrain de 200 m2, sur lequel le r\u00e8glement pr\u00e9voit une emprise au sol maximum autoris\u00e9e de 40 %, on peut construire un logement dont l&#8217;emprise sera au maximum de 200 x 40 % = 80 m\u00b2 ; avec une majoration de 20 %, l&#8217;emprise au sol pourra \u00eatre de 96 m2, et avec 30 % de 104 m\u00b2.<\/div>\n<div><\/div>\n<div><b>3. La majoration des hauteurs maximales des constructions :<\/b><\/div>\n<div><\/div>\n<div>Exemple d&rsquo;application : Dans un centre dense, un r\u00e8glement de PLU fixe la hauteur maximale autoris\u00e9e \u00e0 15 m\u00e8tres comprenant 9 m de hauteur de fa\u00e7ade et 6 m de couronnement. Une augmentation de 30 % porte la hauteur maximale \u00e0 19 m, permettant la r\u00e9alisation d&rsquo;un niveau de plus, du fait de la hauteur de fa\u00e7ade passant de 9 m \u00e0 11,7 m.<\/div>\n<div><\/div>\n<div><b>4. L&rsquo;augmentation de la constructibilit\u00e9 appliqu\u00e9e au gabarit :<\/b><\/div>\n<div><\/div>\n<div>Exemple d&rsquo;application : le gabarit, en architecture, d\u00e9signe la taille et la forme g\u00e9n\u00e9rale que peut prendre un b\u00e2timent en fonction des r\u00e8glements d&rsquo;urbanisme. Le gabarit peut \u00eatre d\u00e9fini formellement par un graphique qui indique les lignes droites ou courbes dans lesquelles doivent s&rsquo;inscrire les constructions.<\/div>\n<div><\/div>\n<div>Un gabarit se d\u00e9compose souvent en deux parties :<\/div>\n<div><\/div>\n<div>&#8211; une hauteur sur rue, qui correspond \u00e0 la hauteur maximale de la fa\u00e7ade verticale au bord de la voie de circulation.<\/div>\n<div><\/div>\n<div>&#8211; un couronnement, qui d\u00e9finit la taille et la forme dans laquelle doivent s&rsquo;inscrire les combles.
