Le d\u00e9veloppement et la diversification des alternatives au logement classique : yourte, tipi, roulotte, mobile home, caravane, etc. rendent aujourd&rsquo;hui n\u00e9cessaire de revoir la r\u00e9glementation. L&rsquo;installation de ces formes d&rsquo;habitat mobile ou l\u00e9ger peut poser question du fait d&rsquo;un cadre juridique inadapt\u00e9. Par exemple, aujourd&rsquo;hui, il n&rsquo;existe pas de r\u00e9glementation concernant les yourtes. Ce vide juridique a conduit \u00e0 une \u00abjudiciarisation\u00bb des relations entre porteurs de projets et collectivit\u00e9s locales, dont il faut sortir par le haut.\u000b\u000bLe projet de loi pr\u00e9sente des dispositions qui vont permettre de :\u000b-\u0001 reconna\u00eetre que les dispositions d&rsquo;urbanisme ont vocation \u00e0 prendre en compte l&rsquo;ensemble des modes d&rsquo;habitat install\u00e9s de fa\u00e7on permanente sur le territoire ;\u000b-\u0001 sortir de l&rsquo;instabilit\u00e9 juridique, l&rsquo;habitat l\u00e9ger consid\u00e9r\u00e9 comme lieu d&rsquo;habitation permanent devant entrer dans le droit commun.\u000bPour sortir du dilemme juridique sur le besoin ou non d&rsquo;un permis de construire, le Gouvernement va autoriser les documents d&rsquo;urbanisme \u00e0 d\u00e9finir les terrains o\u00f9 les r\u00e9sidences mobiles ou d\u00e9montables, constituant l&rsquo;habitat permanent de leurs utilisateurs, pourront \u00eatre\u000binstall\u00e9es. Il suffira de soumettre ces terrains \u00e0 un r\u00e9gime de d\u00e9claration pr\u00e9alable ou de permis d&rsquo;am\u00e9nager.\u000bSi les r\u00e9sidences mobiles ont un statut connu, les r\u00e9sidences d\u00e9montables, de formes diverses, devront r\u00e9pondre \u00e0 un cahier des charges d\u00e9montrant :\u000b-\u0001 la r\u00e9versibilit\u00e9 de l&rsquo;habitat : l&rsquo;habitat est d\u00e9montable, son installation est effectu\u00e9e sans intervention d&rsquo;engins lourds et aucun \u00e9l\u00e9ment le composant, ou composant son am\u00e9nagement int\u00e9rieur, n&rsquo;est inamovible ;\u000b-\u0001 l&rsquo;autonomie vis-\u00e0-vis des r\u00e9seaux d&rsquo;eau, d&rsquo;\u00e9lectricit\u00e9 et d&rsquo;assainissements collectifs, pour ne pas impacter les budgets des collectivit\u00e9s locales via la cr\u00e9ation de nouveaux r\u00e9seaux ; \u0001 la s\u00e9curit\u00e9 : l&rsquo;usager de l&rsquo;habitat devra veiller \u00e0 la propret\u00e9, \u00e0 la salubrit\u00e9 et \u00e0 l&rsquo;entretien des lieux pour \u00e9viter les incendies.\u000bDans le volet du projet de loi relatif \u00e0 l&rsquo;urbanisme, plusieurs dispositions pr\u00e9voient donc que les r\u00e9sidences mobiles ou d\u00e9montables, qui constituent l&rsquo;habitat permanent de leur utilisateur (par opposition \u00e0 une utilisation touristique), pourront \u00eatre autoris\u00e9es en zones urbaines mais aussi dans les \u00ab pastilles \u00bb, ces secteurs de taille et de capacit\u00e9 d&rsquo;accueil limit\u00e9es, pr\u00e9vus par le r\u00e8glement des plans locaux d&rsquo;urbanisme (PLU) dans les zones agricoles ou naturelles, qui sont normalement non constructibles.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le nouveau projet de loi Alur de C\u00e9cile Duflot fait entrer l&rsquo;habitat l\u00e9ger dans les r\u00e8gles d&rsquo;urbanisme.
