{"id":98504,"date":"2018-02-28T09:03:13","date_gmt":"2018-02-28T08:03:13","guid":{"rendered":"http:\/\/batijournal.com\/?p=98504"},"modified":"2019-07-15T12:08:41","modified_gmt":"2019-07-15T10:08:41","slug":"rendre-logements-anciens-centres-villes-plus-attractifs-grace-a-baux-dedies","status":"publish","type":"post","link":"https:\/\/batijournal.com\/index.php\/rendre-logements-anciens-centres-villes-plus-attractifs-grace-a-baux-dedies\/98504\/","title":{"rendered":"Rendre les logements anciens des centres-villes plus attractifs gr\u00e2ce \u00e0 des baux d\u00e9di\u00e9s"},"content":{"rendered":"<p><strong>Plusieurs s\u00e9nateurs r\u00e9dig\u00e9 une proposition de loi ayant pour objet la cr\u00e9ation de baux sp\u00e9cifiques visant \u00e0 rendre plus attractif les logements anciens des centres des villes.\u00a0Les centres-villes des villes petites et moyennes sont aujourd&rsquo;hui trop souvent d\u00e9laiss\u00e9s au profit de zones commerciales et pavillonnaires qui se d\u00e9veloppent en lisi\u00e8re des villes. Les centres-villes historiques se meurent, perdant chaque ann\u00e9e plus de commerces et d&rsquo;habitants. La proposition des s\u00e9nateurs a pour objet de cr\u00e9er deux outils contractuels qui, en \u00e9largissant la gamme des possibilit\u00e9s ouvertes pour acc\u00e9der \u00e0 un logement, ont vocation \u00e0 favoriser l&rsquo;occupation des logements dans les zones souffrant d&rsquo;un fort d\u00e9s\u00e9quilibre entre l&rsquo;offre et la demande.<\/strong><\/p>\n<p><strong>Le premier, d\u00e9nomm\u00e9 \u00ab bail \u00e0 r\u00e9habilitation avec option d&rsquo;achat \u00bb<\/strong>, permettrait \u00e0 des personnes de s&rsquo;installer dans un logement ancien n\u00e9cessitant des travaux qu&rsquo;elles s&rsquo;engageraient \u00e0 r\u00e9aliser en \u00e9change d&rsquo;un loyer dont le montant serait de ce fait n\u00e9cessairement r\u00e9duit par rapport \u00e0 celui qui aurait \u00e9t\u00e9 fix\u00e9, toutes choses \u00e9gales par ailleurs, dans le cadre d&rsquo;un bail \u00ab traditionnel \u00bb. Une dur\u00e9e du bail serait d\u00e9termin\u00e9e afin de garantir au preneur une sorte d&rsquo;amortissement des d\u00e9penses engag\u00e9es pour la r\u00e9habilitation. Le preneur, \u00e0 qui serait conf\u00e9r\u00e9 sur le bien un droit r\u00e9el immobilier, pourrait, en activant un droit d&rsquo;option, en acqu\u00e9rir la propri\u00e9t\u00e9 \u00e0 l&rsquo;expiration de la dur\u00e9e du bail.<\/p>\n<p><strong>Le second outil consiste \u00e0 faciliter l&rsquo;occupation des logements par le recours \u00e0 un contrat d\u00e9nomm\u00e9 \u00ab bail viager \u00bb.<\/strong> Largement r\u00e9gi par les dispositions de la loi n\u00b0 89-462 du 6 juillet 1989 tendant \u00e0 am\u00e9liorer les rapports locatifs et portant modification de la loi n\u00b0 86-1290 du 23 d\u00e9cembre 1986, il s&rsquo;en distinguerait sur deux points essentiels : d&rsquo;une part, au niveau de la dur\u00e9e puisque, comme l&rsquo;indique son appellation, ce contrat courrait en principe jusqu&rsquo;au d\u00e9c\u00e8s du preneur (ou des preneurs pour un couple) ; d&rsquo;autre part, au niveau du prix, qui ne donnerait pas lieu \u00e0 loyer, mais \u00e0 versement d&rsquo;un montant forfaitaire, valant en quelque sorte \u00ab loyer une fois pour toute \u00bb. Ce montant forfaitaire serait n\u00e9cessairement inf\u00e9rieur, et de mani\u00e8re significative, \u00e0 la valeur v\u00e9nale du bien puisque son propri\u00e9taire le resterait et en retrouverait la jouissance au d\u00e9c\u00e8s du preneur. Ce faisant, le bail viager faciliterait la fluidit\u00e9 des transactions : d&rsquo;un c\u00f4t\u00e9, il permettrait \u00e0 des personnes le d\u00e9sirant de s&rsquo;installer durablement dans un logement qu&rsquo;elles n&rsquo;ont pas les moyens d&rsquo;acheter ; d&rsquo;un autre c\u00f4t\u00e9, en particulier dans les zones o\u00f9 les logements trouvent difficilement acqu\u00e9reur, le propri\u00e9taire pourrait obtenir une somme cons\u00e9quente d&rsquo;un bien qui demeurerait dans son patrimoine et qui, \u00e0 d\u00e9faut de bail viager, risquerait de se d\u00e9labrer (ou de constituer une charge lourde).<\/p>\n<p>Au-del\u00e0 des deux nouveaux outils contractuels pr\u00e9cit\u00e9s, l&rsquo;article unique a \u00e9galement pour objet d&rsquo;instituer <strong>un portail d\u00e9mat\u00e9rialis\u00e9<\/strong> destin\u00e9 \u00e0 permettre aux propri\u00e9taires de logements vacants, dans les zones souffrant d&rsquo;un fort d\u00e9s\u00e9quilibre entre l&rsquo;offre et la demande, d&rsquo;y publier leurs offres de vente, de location ou de mise \u00e0 disposition \u00e0 titre gratuit.<\/p>\n<p><a href=\"http:\/\/www.senat.fr\/leg\/ppl17-251.html\" target=\"_blank\" rel=\"noopener noreferrer\">http:\/\/www.senat.fr\/leg\/ppl17-251.html<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Plusieurs s\u00e9nateurs r\u00e9dig\u00e9 une proposition de loi ayant pour objet la cr\u00e9ation de baux sp\u00e9cifiques visant \u00e0 rendre plus attractif les logements anciens des centres des villes.\u00a0Les centres-villes des villes petites et moyennes sont aujourd&rsquo;hui trop souvent d\u00e9laiss\u00e9s au profit de zones commerciales et pavillonnaires qui se d\u00e9veloppent en lisi\u00e8re des villes.
